1) How do we get good & well-paying contracts for our Truck(s), Trailer(s) or yellow machines
The industry has of late been invaded by contract sharks, people who somehow manage to get a lot of good, long period, reasonable, well-paying contracts from small, medium and large companies, when they themselves are briefcase companies connected but owning no trucks and trailers of every size and description for sub-contracting purposes
1.1) So you must first of all shop around for long period, well-paying Main Contractor’s contract(s)
and secure one before you buy any trucks, trailers and yellow machines.
1.2) Avoid at all costs settling for a sub -contractor’s contract(s) because they are a very risky investments.
The Reasons are many but chief among them are:
1.3(a) working capital budgets per truck & trailer are very high as you must fork out money for diesel oils, tyres, insurances, service costs, toll gates and driver wages and subsistence etc for a long period of between 45-60 days before you receive your first payment.
b) thereafter they pay you some 15, 30 and 60 days after submission of your monthly loads schedules or claim statements
c) at times some don’t pay you at all unless you take them to court and/or you start fighting them.
d) as if the headaches associated with late payment or no payments is not enough, these main contractors are famous for paying low rates, to sub-contractors and paying themselves good monies for doing nothing and for their multimillion rands contractual agreement papers.
e) and ofcourse it’s not all of them, so please select them, after carrying out due diligence verting
process(es), to satisfy yourself about their trustworthiness rating(s).
f) you must go for local contracts first until such time that you fully understand the Mathematics of this lucrative industry.
g) take on cross border contracts only if you are the main contractor
h) but if it is for your company’s survival, do your mathematics first with a clear conscience before
signing up
i) make sure you shop around for the proposed route rates, with other industry players and long distance drivers using those routes, before committing yourself e.g. Zimbabwe, Zambia, DRC, Tanzania, Malawi routes etc
j) you must assess all the roads & country related risks, spares availability and road assistance packages, in case of breakdown(s) before taking up loads contracts
k) In respect to payments for all cross border routes or loads you must make sure they pay 50% - 60% deposits, as soon as the truck finishes loading the customer’s goods, before it leaves the collection point and the balance of the agreed amount once the truck or driver reaches its or his destination, either before off-loading or soon after offloading before the driver leaves the delivery point
L) the driver must never leave the point of delivery before the money is in your account NEVER EVER trust nobody. I mean no one, don’t even trust yourself coz you can easily misjudge and totally loose out.

Different movement requisite specifications are given out to interested parties for their perusal, noting and file. Here it is worth noting that these contracts attract different load(s) payment rates and payment methods, mostly the contracts take two different forms as follows:
1.Main Contractor
2.Sub-Contractor
It is always advisable to go for a main contractor contract instead of the sub-contractor one the reason(s) being that experience over time have shown that most main contractors tend to shortchange ground field players on payment rates. To make matters worse they don’t pay on time. This scenario makes life difficult for all size sub-contractors to operate their business(es) efficiently which results in them delivering poor services and ultimately going out of business. These business unbecoming tendencies stand in the way of your business’ growth prospects.
Therefore direct contracts must be your first choice and have good standing through referrals coming in as your second choice and deserved company building bonuses, as a transporter of choice
Make sure you thoroughly go through any proposed contract, fully understand its contains and beware of fine writing. Never rush to sign any contract(s), if possible as a measure of due diligence consult and/or copy the same to your attorneys for their perusal, noting and file.
Never put pen to paper on any contract until you are absolutely certain you fully understand all the contains contained therein.
Make sure the termination clauses and/or conditions give you ample time to look for and enter into other lucrative paying contracts. A minimum termination period on both sides must be 3 months to caution yourself against possible future income losses, especially, if you acquired your moveable assets through banks and/or other financing options available on the market. There must be no any other understandings to the contract contents in this regard. The life of your investment(s) are dependent on what is contained in this transportation contract documents.

Are you in favour of the ANC? No, I don’t mean the political party. I’m referring to the antenuptial contract. Hi. I’m Simon Dippenaar and I’m a family lawyer. Antenuptial contracts, or ANCs, have been around for a long time. In the US they are often called prenuptial contracts, or prenups, but they are all the same thing.
The recent announcement that Bill and Melinda Gates are to divorce – amicably if we believe the news reports – has shone a spotlight on the ANC. Bill and Melinda didn’t have one. So what exactly is an antenuptial contract and how can it benefit a couple?
Before we can unpack the ANC, we need to understand the different marriage rules – or matrimonial property regimes – here in South Africa.
There are three types of marriage. Historically the most common was “in community of property”. This is still the default regime. In this type of marriage both parties are the owners of the joint estate, and when they divorce, they split the marital property 50/50. In a marriage in community of property there is no ANC.
The other types of marriage are “out of community of property” – either with or without accrual. In both of these cases an ANC is required. Very briefly, out of community of property means that all assets owned by each party before the marriage remain the property of the individual. They do not become part of a joint marital estate. “With accrual” means that everything acquired after the marriage is considered part of the joint estate, and is divided equally in the event of divorce. This includes any increase in the net value of each individual’s estate. “Without accrual” is the simplest marital arrangement, but it may not always be the fairest. In this case, all property owned prior to the marriage and all property acquired during the marriage belongs to the person who acquired it.
So what role does the ANC play? It sets out the rules and conditions that govern the division of assets, both during the marriage and on divorce. The contract is straightforward, and declares:
The net values of the estates of the parties at the commencement of their intended marriage
Any exclusions (as per the Matrimonial Property Act)
The accrual calculation, for marriages with accrual
Any other conditions that may impact the accrual, such as insolvency
Then both parties declare their intention to solemnise the marriage and promise each other the full force of their legal obligations with respect to the marriage and property
You may feel it is awkward to discuss an antenuptial contract as part of your wedding plans. You may think it suggests the marriage won’t last. But the reality is…this document can prevent a lot of heartache later on. Some couples even find an ANC makes the marriage more harmonious, as financial disputes are pre-empted by the terms of the contract.
